Al-Arian acquitted on key count of aiding terrorists

TAMPA, Fla. A former Florida professor was acquitted
on a key charge Tuesday that he helped lead a Palestinian
terrorist group that has carried out suicide bombings against Israel.
In one of the biggest courtroom tests yet of the Patriot Act's
expanded search and surveillance powers, the jury acquitted
Sami Al-Arian of eight of the 17 counts against him, including
a charge of conspiring to maim and murder people overseas.
The jury deadlocked on the others including charges he aided terrorists.
Al-Arian, a former University of South Florida computer
engineering professor, wept after the verdicts and his
attorney, Linda Moreno hugged him. He will remain jailed
until prosecutors decide whether retry him on the deadlocked counts.
Co-defendants Sameeh Hammoudeh and Ghassan Zayed Ballut were
acquitted of all charges against them.
Another, Hatem Naji Fariz, was found not guilty of 24 counts
and jurors deadlocked on the remaining eight.
The U.S. Justice Department had no immediate comment.
Al-Arian, 47, is considered one of the most important
terrorist figures to be brought to trial in the United
States since the Sept. 11, 2001, terrorism attacks. His
indictment in 2003 was hailed by then-Attorney General
John Ashcroft as one of the first triumphs of the Patriot
Act, which was enacted in the weeks after Sept. 11.
The Patriot Act gave the government greatly expanded powers
and broke down the wall between foreign intelligence
investigations and domestic law enforcement. In the
Al-Arian case, officials said, it allowed separate FBI
investigations - one of them a years long secret foreign
intelligence probe of the professor's activities - to be
combined and all the evidence used against him.
Al-Arian, a Palestinian who was born in Kuwait, has lived
in the United States since 1975. He was granted
permanent-resident status in 1989 and denied U.S.
citizenship in 1996. He was fired by USF shortly after he was indicted.
The federal jury deliberated 13 days after hearing from
80 government witnesses and listening to often-plodding
testimony about faxes and wiretapped phone calls during
a trial that lasted more than five months.
The government alleged that the defendants were part of a
Tampa terrorist cell that took the lead in determining
the structure and goals of the Palestinian Islamic Jihad,
which the State Department has listed as a terrorist group.
Prosecutors said Al-Arian and other members of the terrorist
organization used the University of South Florida to give
them cover as teachers and students, and held meetings under
the guise of academic conferences.
Prosecutor Cherie Krigsman likened the Palestinian Islamic
Jihad to the Mafia and named Al-Arian as one of its "crime
bosses," like TV's Tony Soprano.
The defendants said that although they were vocal advocates
in the United States for the Palestinian cause and may have
celebrated news of the terrorist group's attacks, the
government had no proof that they planned or knew about
any violence. They said the money they raised and sent to
the Palestinian territories was for legitimate charities.
Al-Arian's attorney, William Moffit, said the professor was
being persecuted for espousing unpopular opinions that
should be protected under the First Amendment.
"Any discussion of Sami Al-Arian being the most powerful man
in the PIJ is fantasy," Moffitt said in his closing argument.
"He never had control of the money, he never made any decisions."
The case was built on hundreds of pages of transcripts of
wiretapped phone calls and faxes, records of money moving
through accounts, documents seized from the defendants'
homes and offices, and their own words on video. At times,
the participants appeared to speak glowingly of the
Palestinian "martyrs" who carried out suicide attacks.
The jury also heard from the father of Alisa Flatow, a New
Jersey student killed in a 1995 bus bombing carried out by
the terrorist group in Gaza.

Remembering the Babri Mosque
Comparison with Buddha statues in Afghanistan

December 6 is the anniversary of the demolition of the
Babri Mosque by Hindu mobs in North India. It is an event
of enormous international significance; yet most Americans,
seem wholly unaware that it ever happened.
The Babri Mosque (also known as the Masjid-i Janamasthan)
was built some time between 1100 and 1600 c.e. Its
construction or refurbishment--it's uncertain which--is
attributed to the first Moghul Emperor, Babur during
his reign (1526-1530).
The largest mosque in Ayodha, (Uttar Pradesh Province, India),
it exhibited classic Jaunpuri architectural style,
characteristic of the period following the Delhi Sultanate.
The sturdy exterior of the mosque relied on rectangular
sandstone bricks. It had one large, and two small elegant
domes, and a beautiful fountain for the performance of
ablution. Long walls enclosed the main courtyard, lined
with intricately decorated pillars and arches
characteristic of the period.
The acoustics of the Babri's main hall were the stuff of
legend: a whisper from the mihrab could be heard clearly
at the opposite end of the hall, 200 feet away. The Babri's
well of curative water, said to heal all manner of ailments,
drew people of all faiths from far and wide.
The Babri was older than the Taj Mahal, the other famous
structure built by a Moghul emperor. It pre-dated the Arc
de Triomphe, and was approximately the same age as
Michelangelo's Sistine Chapel and St. Peter's Basilica.
No matter.
On December 6, 1992, the Vishwa Hindu Parishad (VHP, or
World Hindu Council) and the Bharatiya Janata Party (BJP)
held a rally outside the Babri, inciting Hindus to tear
down the c. 900-year old mosque! Although, Muslims and
Hindus had peacefully shared access to the site for
decades, and the Muslims had not denied the Hindus claim
to it, the VHP and BJP leaders claimed that the mosque
must be removed, so that an ancient Hindu temple, which
[allegedly] lay beneath the site, might be re-constructed there.
Over the course of the day, a mob of Hindus amassed outside
the mosque. They numbered around one million! As members
of the ruling BJP openly incited members of the mob to
violence, destruction of the mosque began in earnest.
While the Babri was being demolished, as well as for hours
afterwards, Hindu mobs pillaged the town of Ayodha, killing,
burning, looting, and destroying. Only two of Ayodha's many
mosques escaped damage or destruction in the rampage.
Following the destruction of the Babri, the BJP continued
to maintain excellent relations with the U.S. government,
as well as with other Western nations. Remarkably, the
BJP's popularity skyrocketed immediately after the
demolition. The party remained closely allied to the
Bush administration--and to Israel--for the duration of
its term in office.
International Significance of the Destruction
On the anniversary of its destruction, a comparison of the
Babri's "death" with the destruction of the Buddhas of
Bamiyan--at the hands of Afghanistan's Taliban
government—is useful. Several major differences between
the two incidents of artifact destruction exist:
Publicly Declared Motivation
*
The Taliban said: the destruction of the Buddhas protested
the fact that UNESCO, NGOs, and the West were pouring money
into restoring statues, when Afghanistan's people had endured
more than two decades of war, and vast segments of the
population were literally starving.

Acharya Dharmendra, VHP leader, said: "Although the local
Hindu residents did ask me to hold the crowds from burning
Muslim homes I would have never stopped them. This is the
only way in which Ayodha could become like the Vatican."

Sanctity of Human Life

The Taliban attacked no human in the process of their action.

Hindu mobs attacked Muslim households, torching and plundering
for nearly twelve hours (per BBC reports) that day. They also
attacked journalists.
Time of Construction
*
The Buddhas of Bamiyan were built in the fifth or sixth century.
**
The Babri mosque was built c. eleventh century.
Right of Worship by Indigenous Populations
*
Afghanistan has no known Buddhist population; the Taliban
action did not violate the religious rights of any local
population which may have used the statues for worship.
**
Uttar Pradesh province has a Muslim population numbering
roughly thirteen million; the Babri was in active use when
it was demolished, violating the right of worship of the
Muslim population.
Reconstruction Efforts
*
UNESCO and various NGOs were pouring money into restoring
the statues—prior to the destruction by the Taliban.
Currently, the Japanese government, and many other
contributors are funding the rebuilding the Buddhas.

Currently, no initiatives have been put forth by the
Indian—or other governments or NGOs--for the reconstruction
of the Babri Mosque. The only efforts to this end have been
by the local population, who are very poor.
Aftermath
*
After its destruction of art, the Taliban government was
largely destroyed by the U.S., and many of its leaders
tortured or tortured.

After its destruction of art, the BJP is regarded as a
friend and ally of the U.S.
The Babri mosque destruction once again reveals the
hypocrisy of the West in its putative concern over
the protection of art and artifacts.

Holocaust Fundamentalism: You WILL Believe
by Mark Green You've seen the films. You've read the books.
You've taken the courses. You've heard the news. Soon,
your children will be visiting the museums.
Everybody knows it's true.
The era of mandatory belief in The Holocaust has arrived.
Articles central to The Faith include unwavering commitment
to Jewish casualty numbers with a full and complete
understanding of the manner in which innocent Jews were
gassed, murdered and executed in Nazi Germany. Recalcitrant
non-believers are now being rounded up. The typical
rhetoric goes: "these bigots deny the facts and lessons
garnered from humankind's experience during WWII. Their
unique kind of poison will not be tolerated. This is a
democracy. You are under arrest."
Only this is not a movie. This is real.
In Europe and North America, Holocaust skeptics are
being apprehended, arrested and are now facing
lengthy prison terms. Few people have noticed. Nobody's
supposed to care. Big media certainly doesn't. Nor the
politicians. These Holocaust-denying apostates include
British author and historian David Irving, Holocaust
revisionist Ernst Zundel, German chemist Gemar Rudolf,
and others. Their crimes involve disbelief: they dispute
the official version of events involving Jews during WWII.
In an era where nearly anything goes, why does the truth
need special laws to protect it? Curious, that.
Beginning Jan. 27, 2006, and continuing every year
thereafter, the United Nations will inaugurate its
first annual Holocaust Remembrance Day. This
Israeli-sponsored resolution not only institutionalizes
and broadens global sensitivity to The Holocaust, but
it will surely aid in prosecuting individuals who reject
official Holocaust dogma. The State Church has arrived.
It's creed: Holocaust fundamentalism.
Question: to what extent do these escalating measures
have more than nothing to do with America's "special
relationship" with the Jewish State, our war in Iraq,
and our saber-rattling towards Syria and Iran?
Just curious.
Resistance to the global New Doctrine however is growing.
Among the arguments:
Laws regulating 'historical interpretation' are themselves
a crime. Take your Thought Control laws and shove it.
Primary question: How many Jews died (and how many
were deliberately killed) during WWII? How do we know?
In how many Western Democracies is doubting the "correct
number " of Jewish victims during WWII now against the law? (seven)
It's known that after the second world war, the Red Cross
put the number of Jewish deaths at considerably less than
one million. That's still a lot of dead people. Yes, it is
theoretically possible that 6,000,000 Jews were killed
during the war, but--forgive me--I sense a bold exaggeration.
But aside from that, since when is skepticism a crime?
Where are the bodies, for instance? May I have a list of names, please?
Even the Yard Vashem Holocaust Museum in Israel, after 60
years, can only muster three million names, and many of
those names are of Jews who merely died (or disappeared)
during WWII, causes unknown. Many names appear more than
once. In a similar vein, while the number of Jews murdered
at Auschwitz was officially reduced by millions in recent
years, the irreducible number of "six million Jews" remains.
Isn't it possible that there's some politically-motivated chicanery here?
It is, after all, indisputable that some earlier "facts"
regarding the Holocaust have been streamlined and smoothed
out for popular consumption. The lamp shade and human soap
stories, for instance, have been quietly retired. The secret
dealings between Nazis and Zionists during WWII have been
suppressed. Another ignored fact concerns the lethal Typhus
epidemics in the death camps. Why have they been
airbrushed from popular memory?
One problem is that all the "experts" tend to be Jewish and
show bias on the subject. How many Germans died in WWII?
Five million? Actually I'm not sure, since their suffering
isn't supposed to matter and therefore their casualties
aren't noted. What was the total number of dead in WWII?--50
million? How many have died in wars during the 20th
Century?--275 million? (that's Zbig. Brezinski's estimate).
Considering this, even if six million Jews were deliberately
killed during WWII, shouldn't we demand that the Zionized
world stop caring so singularly about Jewish suffering? The
Jewish obsession with everything Jewish is shamefully
narcissistic and burdensome. Their defiant ethnocentrism
is an ongoing insult to the rest of the human race.
As for the "un-revisable" six million figure, Jews
have superstitious reasons pertaining to the number
"six" for claiming that six million died. In fact,
similar charges about six million Jews were made,
incredibly, in 1919, concerning the fantastic number
of Jews facing death during WWI. These nutty allegations
were even published in the NY Times. The claimants were Jewish.
But why?
Another reason Jews want to hype the number of victims is
that they wanted to have the greatest casualty count so
they could claim supreme victimhood and reap the political
rewards. Holocaust lore is essential to the precarious
legitimacy of the Jewish State. Just ask the Palestinians.
But the Holocaust story as now told is a libel on the
German people, since it pretends to show that German
anti-Semitism sprang from nowhere. But the real
story is more complicated.
Rightly or wrongly, the Nazis blamed the Jews for America's
entry into WWI as well as the unjust and punitive Treaty of
Versailles which followed. It's also undeniable that
international Jewry "declared war" (and launched an
international boycott) on Hitler's Germany in 1933. Even
the outrage know as "Kristallnacht" was provoked in part
by a Jewish assassin (Herschel Grynszpan) who, on November
7, 1938, walked into the German embassy in Paris and shot
and killed Ernest vom Rath, a German diplomat.
We know, for instance, that soon after the turn of the
century, Jews comprised many if not most of the leading
political radicals in Europe. They were instrumental in
orchestrating and managing the Communist revolution
which killed millions of non-Jews well before Hitler's
rise. Why aren't the Nazi-hunters interested in finding
any of these mass-murderers? Is it justice they're after,
or revenge and political advantage? The "innocent
little Jewish shopkeeper" archetype as peddled on TV
is a self-exculpating myth.
However, that Jews were persecuted and murdered during
Hitler's reign is irrefutable. I've never seen or read
a Holocaust "denier" who claims otherwise. Not one. The
extraordinary claim that "6,000,000 Jews were
systematically murdered" is what they contest. This
deliberate mischaracterization of Holocaust revisionism
has been spread widely and purposefully by keepers of the
Holocaust faith. And the disinformation continues to flow.
David Irving, the imprisoned author of dozens of works
on WWII, is now alleged to have recently "recanted" some
of his "Holocaust denial claims". But his change-of-heart
cannot be believed so long as he is being held captive
on account of his scholarship.
Historical truth doesn't need to be protected by any special
law or speech code. Irving, Zundel, Rudolf and others, need
and deserve our unwavering support if we intend to remain
even nominally free.
